The minutes from the November 14, 2005 were read and revised. Motion was made to accept minutes with changes, seconded, motion passed.
Thelena was absent, update provided by Heather. Nine people got delinquent letters, all nine responded by paying their outstanding dues.
Election of officers: Thelena agreed to stay on as Treasurer, Heather agreed to continue as President, Michele will become Vice President but continue the newsletter, Mary Beth will become Secretary. John Clay will continue as AERC representative. As the AERC representative, John will continue to keep track of the architectural changes and provide monthly to the Secretary for insertion into the minutes.
The pond transfer has started. A delay has occurred because it was discovered that the Declaration of Covenants does not mention the ownership of the storm pond. The attorney, Christopher Hitchens is checking who actually owns the pond. The Lawyer should have an answer in 2 weeks. He will provide a land plat as well.
There continues to be an issue with the house with blue siding: the covenant on the house has not been changed as agreed to between the Board and the homeowner. The covenant would require the siding to be changed at the time of a sale or the new owner would be required to change. Work is continuing on this.
Two requests made verbally for architectural alterations are pending, one for a fence (non split rail) and the other a shed. Neither has been received in writing.
Heather received an email regarding a parking space that is unmarked in the townhouse area and debris that is behind the houses. A discussion took place regarding the need to remove the debris that is on Park and Planning property followed by a general discussion on covenant enforcement and penalties for violations.
A motion was made and seconded to send a warning letter initially for an infraction, and then if not corrected or appealed within 15 days to have the lawyer send a letter at which point the homeowner will be charged $200 fee to cover the lawyers fee (estimated to be $175 per letter) and a $25 penalty to the HOA. If the infraction is still not rectified the lawyer can place a lien on the property. The motion carried. To enforce this action, homeowners will be presented with a dated picture. Fines would go on their quarterly bill. This will most likely be done through random enforcement.
Architectural Approvals:
-Lot 47E (18929 Marsh Hawk Lane) – This was a follow-up to earlier request to install a shed. The AERC requested a follow-up request including the shed color. Request was approved.
-Lot 15E (18901 Blue Heron Lane) – request to install an Almond color garage door. Request was approved.
Bills go out April 1; all articles for the next newsletter need to be submitted to Michele by March 17. Articles to be provided: a warning about cleaning up common areas and about dumping on common areas and the possibility of a fine (Heather); reminder that you cannot have signs advertising your business outside your property, but we can offer space on MWHOA website for neighborhood businesses (include a disclaimer on the website); an article on the types of insurance that are needed by homeowners; and an article about cleaning the siding of algae and repair fences.
Heather reported that the email is online now. Covenants and bylaws are also on the website. It was suggested to put a list of all AERC approved requests on the website.

Mary Beth will be checking how Centerway Road is classified either as a primary road versus a major artery. The speed and erratic driving on Centerway Road requires us to look at various options for traffic calming methods. We first must find the right office to contact. Check with Mrs. Krumm or Aruna Miller.
Meeting dates were approved; the meeting start time was moved to 7:00. The Treasurer’s report will be moved to later in the meeting to allow time for the Treasurer to arrive.
A discussion took place regarding excessive speed down Marsh Hawk by new residents and the possible high occupancy of the former Cooper house. Heather will take action on this issue.
